DISPOSITIVA Por todas las razones expuestas, esta Corte de Apelaciones del Circuito Judicial Penal del Estado Lara, ADMINISTRANDO JUSTICIA, EN NOMBRE DE LA REPÚBLICA BOLIVARIANA DE VENEZUELA Y POR AUTORIDAD DE LA LEY, procede a decidir en los siguientes términos: PRIMERO: DECLARA SIN LUGAR, el recurso de apelación interpuesto por el Abg. Jesús Enrique Bastidas Colombo, en su condición de Apoderado Judicial del ciudadano LUIS ALBERTO COLINA HIGUERA, en contra de la decisión dictada en fecha 20 de Abril del 2009, por el Tribunal de Primera Instancia en funciones de Control Nº 10 de éste Circuito Judicial Penal, Extensión Carora, mediante el cual declara Sin Lugar la solicitud de Entrega del Vehiculo la entrega del Vehiculo BATEA MARCA FABRICACIÓN NACIONAL, MODELO CHA, AÑO 1983, COLOR AZUL Y BLANCO, CLASE REMOLQUE, USO CARGA, PLACAS 903-LAF, SERIAL DE CARROCERÍA 01570207 (SUPLANTADO), al ciudadano LUIS ALBERTO COLINA HIGUERA.
