D I S P O S I T I V A Por los razonamientos antes expuestos, este TRIBUNAL MILITAR DUODÉCIMO DE CONTROL CON SEDE EN MÉRIDA, ADMINISTRANDO JUSTICIA EN NOMBRE DE LA REPUBLICA BOLIVARIANA DE VENEZUELA Y POR AUTORIDAD DE LA LEY DECIDE: PRIMERO: Declara con LUGAR, la solicitud realizada por la ALFEREZ DE NAVIO TAHIBETH LOLIMAR PEREZ CHACON , Fiscal Militar Auxiliar quincuagésima de Barinas con Competencia Nacional; en consecuencia DECRETA LA MEDIDA DE PRIVACIÓN JUDICIAL PREVENTIVA DE LIBERTAD, en contra del ciudadano SARGENTO SEGUNDO JOSÉ FERNEY JIMENEZ JIMENEZ, titular de la cedula de identidad N° 20.519.536, plaza del 932 Batallón "Cnel. Vicente Campo Elías" , por estar incurso en la presunta comisión del Delito Militar de DESERCION, previsto en los artículos 523, 527 numeral 1º y sancionado en el artículo 528 del Código de Justicia Militar, por considerar llenos los extremos exigidos en los artículos 236 y 237 del Código Orgánico Procesal Penal vigente.
